Private Security Legislation Changes - What Homeowners Need To Know

Proposed amendments to South Africa's private security legislation are poised to significantly reshape the paradigms of safety and security for both homeowners and property investors across the nation.

The new draft regulations, particularly those pertaining to the Private Security Industry Regulatory Authority (PSIRA) and the protocols surrounding the use of firearms by private security personnel is a key area of focus for all stakeholders.

The proposed regulations, seemingly designed to bolster accountability and rectify existing issues within the industry, encompasses several key areas. These include the implementation of more stringent record-keeping practices for firearms, the establishment of limitations on the types of firearms permissible for various security functions, and, critically, new restrictions governing the deployment of armed security officers in certain public and semi-public areas.

Richard Gray, CEO of Harcourts South Africa, acknowledges the multifaceted nature of this issue. 

"The paramount importance of safety and security for property owners cannot be overstated; it is the very bedrock upon which a stable and thriving property market is built," Gray said. "While we wholeheartedly understand and support the government's objective to enhance regulation and accountability within the private security industry, it is of utmost importance that these transformative changes do not inadvertently compromise the safety and well-being of our communities. Furthermore, they must not impose an undue financial or logistical burden on homeowners who rely on private security services for their protection and peace of mind."

South Africa's private security industry is substantial, frequently bridging a crucial gap in ensuring the safety and security of citizens. Property owners make significant investments in private security services as a primary, and often necessary, measure to safeguard their families, employees, and valuable assets.

"A significant number of South African property owners have, over time, developed a strong reliance on the visible presence and rapid response capabilities of private security personnel, especially in regions where public safety resources may be limited or overextended," Gray explained. "Should these new regulations lead to a reduction in the effectiveness of private security, it could trigger a cascade of adverse consequences. Homeowners might experience heightened levels of anxiety and insecurity, potentially face an escalation in insurance premiums, and, in the broader, long-term perspective, we could witness a detrimental impact on property desirability and market values in affected areas."

Industry experts have expressed concerns around the long-term impact on criminality if private firms are perceived as being less effective in fighting these elements.

"Property represents a substantial, often lifelong, investment. Its intrinsic value is inextricably intertwined with the perceived and actual safety and security of its surrounding environment," Gray continued. "Any legislative adjustments that carry the potential to weaken the security infrastructure that protects these vital investments warrant meticulous consideration and broad consultation."

Gray adds that another, very real, consequence for homeowners could be an increase in security costs. If private security companies experience hikes in operational costs due to increased complexity the increases need to go somewhere and ultimately, it's the financially-stretched South African property owner that will end up shouldering it.
